THE FATE OF ELLIS.
BEFORE THE EXECUTIVE. AFFEDATIT BY A WITNESS. {By Telegraph;— Press Association.) WELLINGTON, this day.
•Mr Wilford. - counsel for Ellis, sentenced to death for the murder of Collinson, a-t Te Awaite, this morning forwardM to the Executive an affidavit by MeDohough, one of the Grown witnesses in the case. McDonougb. in this affidavit challenges the evidence of Grant, another Crown witness, who swore that he saw McDanough on the morning of the murder at. the spot from which MeDonough said he saw Ellis- This evidence was called by the Grown to corroborate McDonough's ovm statement that he was in the vicinity and saw Ellis there. Grant was severely cross-examined at the trial as to the range of the telescope which enabled him to see Mc-Dono-ugh. The affidavit of MeDonough states that he met. Grant that morning between 7.3Q and S a.m. Grant told him he had just come from Waipawa. seven or eight miles away, and in a different, direction to that in which Grant swore he had been. MeDonough also says Grant's statement as to his having only being pig. shooting once β-jth witness was proved to be untrue. Mr Wilford, in a letter to the Executive, claims that this affidavit further raises the doubt. "Have we had the truth, the whole truth, nothing but the truth"? The Executive is considering the case to-da.v.
