(By Telegraph.—Own Correspondent) HAMILTON, this dayJudgment was delivered to-day in the case of the Hamilton Borough Council*. N. H. Knock, charged with a breach of the by-laws in refusing to employ th* sanitary pans. This was a test case brought by the Couneil-in-Order to ascertain -whether it can enforce the mmtsiy system. The case had been postponed for several months, and in *"* t meantime the whole system wisnung up. The question at issue hinged on the validity of the by-law. The magUtratt held it was not bad as it left an es»»tial point to be covered by resolutionThe defendant was fined 1/ and ooiW. Leave to appeal was granted. ' Mr W. Sutton, of Staveley, Mount Somers, Canterbury, died here at tl» residence of his son-in-law, Mr H. Hartley. Deceased came to the Waikato Christinas time for the benefit of health. He was 53 years old. and _* colonist of 30 years' standing. *» interment will be made at Ashburtoa.
