(Before His Honor Judge Beckham.) ■ RYAN, BELL, AND CO. V. MORRKOW.
Mr Hesketh appeared for plaintiff, and Mr Whitaker for defendant.
The plaintiffs in this action are Messrs Ryan, Bell, and Co., merchants, of Vulcan Lane, and the defendant is commander of the ship Emily McLaren. 3he claim was for the sum of £140, the value of a billiard table alleged to have been broken and rendered useless while in defendant's care in its passage from London to Auckland. Counsel on both sides having spoken in favor of their respective clients, the witnesses were called.
Thomas James Bell, one of the plaintiffs, deposed that the firm were the consignees of the goods mentioned in the bill of lading, and they had received the live cases mentioned therein ; but one of the cases was in a very bad condition; it contained three slates, about 1$ of an inch each, which were broken in the centre. The table was rendered useless ; the value was £140 complete, the amount claimed.
