RESIDENT MAGISTRATES COURT.THIS DAY.

(Before Thomas Beckham Esq., R.M.) The weekly sitting of this Court for the recovery of small debts was held to-day, and the following cases heard and disposed of :— JUDGMENTS FOR PLAINTIFFS. Wm. Chapman v. Walter Wall, claim 9s for a shackle ; Auckland Gas Company v. Patrick Harkin, (Mr Thorne for plaintiff,) claim £1 19s for gas; James Reid v. Mary Fisher, (Mr Laishley for plaintiff,) claim £2 14s groceries, 4s a-week ; and D. Stephenson v. Daniel O'Keeffe, (Mr Meyer for plaintiff,) claim £10 3s6d intwo instalments. G. W. BINNEY V. JOSEPH CBAIG. Claim, £7. Mr J. B. Russell appeared for plaintiff, and Mr McCormick for the defence. Mr Binney deposed that he held an auotion sale of some maize on October 16th, and defendant attended and purchased one line or parcel of maize in the cellar, consisting of 140 bags at Ss Gd. Mr MacCormick admitted that there was an error in the price, which was the cause of dispute. His Worship said Mr Binney had better continue his evidence. Mr MacCormick said that 7a 6d was the price agreed upon, otherwise Mr Craig would be a considerable loser. Mr J. B. Russell objected to this course, as Mr MacCormick would have the opportunity presently of delivering his defence. Mr Binney continued: The price, Ss 6d,was audibly announced in the hearing of Mr Craig, and knocked down to him accordingly. Mr Craig's name appears in the auction book as the purchaser. There was 8s bid by others. _ Mr MacCormack objected to these questions Mr Binney did not make the entry. Edward George Smith Auckland, clerk to Mr Binney, remembered the sale in question and the bags of maize being sold to Mr Craig for the amount specified, and which was delivered to Mr Craig. Mr MacCormick objected. The price was the question. He did not deny the delivery. Mr J. B. Russell objected to be dictated to by Mr MaeCormiok. He was competent to conduct his case.
