The Court resumod its sittings this morning at 10 o'clock. EAPB. The case of rape at Tauranga, against James Mcßae, was again proceeded with. At the application of Mr MacCormick, for the prisoner, the prosecutrix's depositions taken at the Police Court were read over, after which Mr MacCormick addressed the jury on the prisoner's behalf, pointing out the discrepancies in the girl's evidence, also urged that her actions tended to show that she was a consenting party. Mr Brookfield replied, and the Judge summed up the whole of the evidence carefully and minutely. The jury after ten minutes' deliberation found the prisoner guilty. His Honor animadverted in strong terms on the prisoner's behaviour towards a girl that it was his duty to have protected as a father, and pointed out to him the enormity of the offence of which he had been guilty, and passed a sentence of eight years' penal servitude on him. The prisoner frequently interrupted the Judge while passing sentence, and denied that he had been guilty of using violence; he said that he.looked upon these proceedings, however, as a judgment against him for his past immoral life.
