NEES V. CORCOBAN AND — Mr. MacCormick for the plaintiff; Mr. Hesketh for the defendant Corcoran, and Mr. Rees for the defendant Seccornbe. —The case for the defendantß was opened this morning. The iinswer to the action, and to the evidence ol the plaintiff, was a denial of all the material allegations. As on the two previous d.iys, the examinations »vere extremely 'protracted.— Air. Brookfitdd, solicitor, who hud the professional conduct of some of the dealings between the parti s, was the first witness called. Hi ■jiive a very different version of what transpired from that given by the plaintiff. Ue sui that Corcoran consulted him in rospect to the purchase of the Tairua saw-mill Witness said it was too large a transaction for him, as he knew nothing about a saw mill. Mr. Nees was mentioned as m Derson capable of managing the mill, and upon tho suggestions ot both Corcoran anc' Npcs, an agrecmeut wus made by which N"ees was to be manager of the mill at £4 a week, notice of threa month* to be given on < ither sidi', Ne»:s to havf power to eng-ige and dismiss workmen In snswer to v question ho* it wij that the name of Nees wa* to the promissory note, the witness said that Corcoran promised Nefis an interest in tho mill when he could raisithe money.
