It was gone fully into on the previous day on thy part of tb c plaintiff, 'i his morning several witnesses were called for the defendant, among them being Mr. Kinlooh, the veterinary surgeon, who gave it as his opinion that the horse was not fatally wounded, and would have recovered if properly treated —but it was killed by plaintiff's oiders.
