ONEHUNGA.

In the Resident Magistrate's Court, on Wednesday, before C. Mellsop; Esq., 8.M., the following business was transacted : — Drunkenness.—"William Swanson, for this offence, not appearing, a warrant was issued for his apprehension. Civil Cases.—Fleming and Stephenson v. McKenzie. Claim, £15 3s. 6d. Judgment confessed. —Fleming and Stevenson v. Taylor. Claim 16s. 3d. Judgment for plaintiff— Fleming and Stevenson v. Stewart. Claim £4i 10s., for 5 per cent, commission on sale of property for £90. Defendant denied having given plaintiff any authority to sell his land. 0. C. Fleming proved that defendant authorised him to find a purchaser for one acre of land. He did so, and under this authority sold the land to a Mr. Eastwood, made out the sa'e nole, and did all that was necessary, and defendant afterwards confirmed the salij. Defendant, On oath, deposed that he never gave plaintiff permission to sell his acre. He told him if he knew of a purchaser lie would be obliged if plaintiff would send him. Mr. Aitken, in Auckland, had his authority to sell, and when the land was sold he told them distinctly he could not make a hargain t'll he had seen Mr. Aitken. Judgment for plaintiff, with costs.
