WEDNESDAY, MARCH 1. [Befoi'e His Honor Sir G. A. Arriey, Knight, Chief Justice.] The usnal weekly sitting in banco as held to-day. His Honor took his seat on the bench at 11 o'clock. LoHHINdON V. 0 ARTWBIG-HT.—Ml1. J. B. Russell,iDovdd the Court to dismiss the plaint in tho action, on the ground of non-proceeding, by the plaintiff. The writ was served on the Ist NovembeV,. 1869, and the defendant appeared to the action on the 15th of November, but the pl.intiff had never taken any1 further ttep. - Gardner t. Greenway.—This was an application \mder the Trustees of Wills A.ct to obtain-certain money ovA of Court. The trustees had paid the moneys into Court, and the present application was to obtain a portion of that money (£44012s 2d) viz., £110 3s OH. Mr. llesketh appeared for the plaintiff; Mr. Whitaker for the trustees. There was no question in, dispute, and it was arranged between counsel that no costs "should be asked. It:appeared that the questions involved had been alreadyl argued.on a previous occasion, when.tho eldest child participating under the will r,cathe of. age. > Another child, Rebecca, Louisa Gardner, now had come of age, hence tho application. Order made accordingly.
