fßefore J. S. Macfarlane and H. M. Jervisj Esqs., Justices.] DKTTNKGNNESS. C. Mills, J. Rankiu, J. Jnnson and P. King, were each fined 5s and costs, or to be imprisoned 24 hours. O. Quinn for a third offence was fined 20s and costs, or to be imprisoned 48 hours with hard labour. ■WTIFUL DAMAGE TO PfiOPERTY. John liyan was charged with having wil" fully broken in the door of Michael Burke. Mr. Joy for tho defence. Michael Burke, deposed : On the night of the 24th August, between 1 and 2 o'clock, I heard a noise at the door, and on my going down, from tho hammering the door fell in, the hinsjes being broken ; saw prisoner with two others close to the door, he had a large stone iv his hands. I went to the Police Station ; had not had a quarrel with defendant or his brothers.

To Mr. Joy : I did not see which of them did the damage; the two others might have done it; I will not swear that defendant broke the door. Carolina Burke, wife of M. Burke, corroborated the statement of the previous witness ; saw defendant and his two brothers about a yard from the door.. Cross-examined at considerable length by Detective Murphy deposed to having found the hinges and casement broken; about a pound would repair the daim-e done. For the d fence, W. Halliday, deposed: I am a Pensioner in Her Majesty's service. I live in the same house with defendant in Abercrombie-street. I arrived from the Thames on Tuesday evening, the 24th of August. From a quarter to ten till sunrise I was in my own home. Defendant came in at five minutes to eleven, and got a match to go to hia bed. I have never known his being out after 12 ; he mu>t pass through my room ; I swear that he could not have gone out again without obtaining the key of the outer door from me; he did not get the key on this occasion, and could not have got out. lam positive about this. The case was dismissed. FALSE PKETENCES.

Edward Walsh, was charged with having obtained from J. C. Morrin 40 lbs of tobacco, by falsely alleging that he was procuring it for E Dent, "of Wangarei. Mr. Jo.y who ■appeared, instructed by Mr. Kodgers for the prosecution, stated that he did not feel justified in submitting evidence, and the case was dismissed.
