SUPREME COURT.—SITTING IN BANKRUPTCY.

Mr. Whitaker aud Mr. Eees r )pe£.J.ficl in support of the issue of a writ of pi'ohibition. This was an application for a writ of prohibition directed to the Judge of the Native Lands Court, prohibiting him from issuing a certificate under the Native Lands Act, in pursuance of an order made by that Court on the 9th of February last.
The circumstances out of which the proceeding arose are the following : —lt appeared that in the early part of 1868, Mr. Robert Graham negotiated with certain natives at the Thames for the lease of certain lands. These lands had not at that time been the subject of any proceedings in the Native Lands Court. On the 23rd of June, 1869, the Nativo Lands Court sat, and made an order for a certificate to the native owners. On the 9tb. of July following, Mr. Robert Graham obtained a lease from the natives. Subsequently, in October, a certificate of title was given to the natives, is pursuance of the order made on the 29th of Juno. The present proceeding w-as taken under the Bth section of the Native Lands Act, Amendment Act, 1869. Subse quen tly, Messrs. Lundon and Whitaker obtained a lease of the same land from the the natives, and the rights of the parties were contested in the Native Lands Court during its last sitting. The question involved is, whelher Mr. Robert Graham or the objectors have the better title to the vesting of the iegal estate under the authority of the Court (Left sitting.)
