CIVIL CASES.
J. Guthrie v. R. Bayley, claim £5 8s 6d for medical attendance. Mr Sims on behalf of plaintiff said, that he had been to defendant's house and asked for a cheque for the amount sued for. He was collecting for Dr Guthrie. Defendant had told him that he had paid £1 17s 6d of the account before. He had asked to see the receipt and defendant refused to let him see it, saying it was too far down the file. Defendant had offered to pay him the amount less £117s 6cl for which he had a receipt, but he refuted to take it till he had seen the receipt.
Defendant stated that he had refused to show the receipt to Mr Sims, as it was given by Mv Sims himself and he thought lie ought to know about it. He would produce the receipt (receipt produced). He had paid the balance into Court.
The iiench said that they considered defendant had given a great deal of unnecessary trouble by refusing to show the receipt, which he ought certainly to have done, when Mr Sims asked him, he, defendant, would therefore have to pay the costs of the case.
Moore and Co. v. F. Orchard, judgment summons, claim £2 3s. Mr Robertson appeared to inform the Court that Mr Orchard was willing to pay the amount in 14 days. Plaintiff agrei-d to the terms offered and the Court adjourned.
