LITTLE RIVER ROAD BOARD.

The ordinary monthly meeting of this Board was held on Monday, the sth inst., Present—Messrs R. A. Forbes (chairman), T. H. Parkinson, J. Judge, nnd F. Birdling. Tho minutes of former meeting being read and confirmed, the Clark's report waß considered, after which a petition was presented from some of the inhabitants of Little River and others, requesting that the road from Okute Valley to the hill top be benched. Resolved, that finding some names on said petition of persons who on a former occasion were * opposed to this work, the Board postpone the consideration of the matter to a future meeting, particularly as they are not aware that the line is clearly defined. Resolved, that the action of the Clerk in authorising m J. Clarke and Gilroy to clear the landslips off the Little River Hill road, as the contractor whose tender had been accepted refused to do the work, be approved of and confirmed; also, that the repairs necessary to tho various parts of the main road be attended to by the Clerk. The contractor for carting metal from the river bed at Little River waited on the Board to learn what tteps he is to take in consequence of being obstructed by the Natives from carting said shingle. Resolved, that the Clerk give the Natives the requisite 24 hours' notice, as set forth in clause 65 of the Roads Ordinance, and caution them HNF that any opposition to the contractor in the discharge of his duty will render them liable to a penalty, and that any person thus interfering will be given in charge. that the old timber in Kimber's Wf Bridge be sold by the Clerk. Correspondence was received from the Halswell Road Board, offering to pay a certain sum towards repairing the road leading to Dunford's Valley, provided this Board pay an equal nmount, &c, as this is a boundary road. Resolved, that this Board is willing to subscribe an equal amount, if necessary, and that the Clerka of both Boards meet and arrange what is necessary to be done, and that a specification of tbe work be prepared conjointly, which is to be approved by the Chairmen of both Boards, Wk and tenders called for the work, to be B lodged at tho Little River Road Board W Office not later than noon on Friday, 30th V ** inst.; also, that as said road is in this district, that tbe supervision of the work be \ carried out by them, From Mr Ware, enclosing receipt for £2, amount voted by *■'■ the Little River and Springs Boards for extra sheathing snid to be in Kimber's , Bridge, nnd claiming a larger amount for same. Resolved, that tbe Board cannot entertain said account. From the Union Bank, acknowledging receipt to credit of Board of Government subsidy, £206 lis Gd. From Colonial Treasurer, advising same. River branch line iy under consideration. From the chief surveyor as follows: — " Sir,—Referring to Mr G. R- Joblin's I encroachment on tho public road, I can only advise you, in the circumstances stated in your letter of the 14th inst., to report the matter to the Government and ask the opinion of the Attorneygeneral anent it. In one of the angles given in the Grant issued for section 2485 tbere is no doubt a clerical eiror, which places it in a position different to that assigned to it by the original survey, so far as regard the side lines, but in my view, neither thi3 grant nor any other grants of adjoining sections so absolutely fix the position of the main road as to permit the proprietors of adjoining sections to encroach on the present road, as formed and used by the public. The proposed encroachment by Mr Reynolds is a matter about which you should consult your solicitor, who will probably advise you to instantly prosecute under Clause 97 of * The Public Works Act, 1876,' any person who encroaches op a road by making on it any building, fence, etc., (see the clause in question), and to leave it to Mr Reynolds to prove his right to the land, which I think be would find extremely hard to do. A similar course of procedure would probably have stopped Mr Joblin. —John H. Baker, Chief- Surveyor. Resolved, that the Clerk seek advice from the Attorney general as proposed. Resolved that the Minister of Public Works be reminded of his promise to attend to the consideration of the damages to our main roads and bridges caused by recent floods, with a view to grant assistance towards repairing them. The next meeting of this Board will be held" on Friday, 30th inst.
