Pitcaithly v. Ha}*. The following judg muit was given :—

The Bench said, that owing to the number of fires burning in the bay, in the same neighborhood, on the 21st of March, and before; it was almost impossible to distinguish which did the damage. They therefore thought that there was not evidence sufficient before the Court, to prove that the fire in question really did the damage, and should give judgment for defendant with costs.

Great stress had hecn laid upon the evidence of Augustc Wilson, but the Bench expressed an opinion that he gave it in a most straight-forward manner. Hie costs of. the case amounted to no less than £133 2s.
