AKAROA BOROUGH COUNCIL.

Present:—His Worship the Mayor, Crs McGregor. Bruce, Chamberldn, Cullen, Brown, Black, Adams and Gutberlet. MINUTES. The minutes of the former meeting were read and confirmed. OUTWARD CORRESPONDENCE. The outward correspondence was read and approved. INWARD CORRESPONDENCE. Correspondence wis read as follows : — From Minister of Justice, asking number of ratepayers in each ward of the Borough. It was agreed to send the nrnnber of ratepayers in the whole Borough, as there were no wards. From Mr Bateman, asking for tbe Town Hall for Saturday in order to lecture on Co-operation. It was pointed out that the cooperation had nothing whatever to do with tho Town Hall. From Mr Bunid, contractor for Balguerie street improvements, asking for loan of Borne of the Council's cement. Application granted. From Mr J. Vangioni, asking permission to erect addition to his chop in Lavaud street. Application granted From Mr W. D. Wilkin, as follows :— '•I enclose as requested account for survey work done for your Council, which I trust will be found correct. I bave not included in this account the charges for survey, specifications, etc., connected with the Balguerie btrect contract, as it is still pending. I think, perhaps, the most satisfactory way to meet your Council in this matter would be to charge a percentage on the outlay, such percentage to cover cost of survey of Btreet lines, for fence notices, etc., levels additions to and alterations of Mr Fenton's specifications, and also supervision of contract during its progress. If you concur in this view, I offer to do the above work for 7 per cent on outlay ; if you do not I will be glad to meet you in any proposal you may be pleased to make. " Yours, etc., " W. D. Wilkin, " District Surveyor."

It was agreed thatllrAVilkins's offer be accepted, on the motion of Cr "Chamberlain, seconded by Cr Adams, Cr McGregciir speaking in support. v REPORTS. The Mayor read the following report from Cr Adams, and stated that he had made the payment:— " In accordance with the desire of the Borough Council. I have inspected the new boundary fence between the Roman Catholic Church property and the Town Reserve, and find that the fence is erected in compliance with the specification, and ! I may further remark that the work is exceptionally good and substantial.—Yours, etc., " T. Adams." The report was adopted and the Mayor's action approved. WORKS COMMITTEE REPORT. The following report was read :— " At a meeting of this committee held September 26th, 1881, present, Messrs Cullen (chairman), Garwood, and Adams, the Chairman and Mr Adams stated that they had visited and examined the locality '* of the late overflow of the mill stream, and report that it is not advisable to undertake any work to the outfall near Mr Waeckerle's while the main watercourse is in its present state. They further report that they have visited the land slips in Ay liner's Valley road, and consider that the employment of a man for two or three days to remove port ons of slips and clear out watercourses will be sufficient for the present. The Works Committee also consider that as there is no urgent necessity

for extending the culvert at Armstrongs Creek, that the matter be allowed to stand over for the present. '■John Cullen, Chairman." "* Cr McGregor objected to any interference with regard to tho creek at Wneckerle's. It was explained that the report referred ♦•to the upper part of the creek. His Worship said that there was an impression abroad that tho Counoil had something to do with this boundary creek. He wished the public distinctly to understand that they had no right to interfere with it. Cr McGregor moved the adoption of the report, and in doing so drew tbe attention of the Works Committee to clause 188 of the Municipal Act with regard to Aylmer street. Tho report was then adopted. THE TOWN BOUNDARY The following report on the town "boundaries from Mr Wilkin (with accompanying plan), was read.— " Akaroa, September 27,1881. " His Worship the Mayor and the Borough "Council, Akaroa, "2?<s Borough Boundary, Akaroa, (i Gentlemen,—As instructed by the Akaroa and Wainui Road Board acting in conjunction with yourselves, I have endeavored to fix that point of-, the Town boundary marked Am tbe plan herewith which I beg to enclose for your inspection, I have put a peg in the ground. " You will observe that the course of the creek which forms the boundary as shown on the old maps is totally changed, and on the ground it is now impossible to say where the watercourse was located at the time the limit was originally fixed. In Mr Pavitt's map the boundary ie shewn apparently round an island which probably existed when Mr Pavitt made his survey, but which is not now visible, unless the ewauipy drain between A and the Grehan Road represents what was once a creek bed. A few days since I examined the 10 chain map at the Chief Surveyors office in Christchurch, and it agrees with tho old 4 chain map ot the Town. None of them shewing any such island. I made a traverse of the present watercourse and it is shewn ir. blue on the plan.

"As a shifting creek such aB that under discussion must at any time form a bad bonndary mark, and as it is manifest that though the creek does change, the Town Boundary should not do so after being gazetted, I would suggest that the boundary be definitely fixed in straight lines, either as shewn in yellow on plan, or by one line direct from A. to point marked B. on the beach, thus settling for ever what may in the future prove a fertile course of misunderstanding between your two bodies. " I am, gentlemen, ■*• Your obedient servant, 11 W. D. Wilkins, " District Surveyor." Cr McGregor moved that the letter be received and the matter be allowed to remain aB it is at present. Seconded by Cr Cullen and carried. FINANCE. The Treasurer's report was rend, as follows :—

"Receipts since last meeting—General rate, 1881, £25 17s Gd. Credit balance at bank at date, 264 7s 7d. Account to be presented—C. Burns, progressive payment, £38 ; W D. Wilkins. t-urveying boundary and engineering, £2 6s 6d ; W. Sims, one month's Hilary, £4 3s 4d; G. H. Sadler, fencing as per valuation, £7 10s; A. Mitchell, day labor, 7s ; H. Burke, day labor, £1 6» 6d ; total, £53 13s 4d. " W. Sims, Treasurer." Tbe accounts as read were passed for payment. NEW COUNCILLOR. Mr Wm. Meech. having made the customary declaration, here took his seat as ft councillor. His Worship congratulated Cr Meech on his election, and welcomed him as a member of the Council. Cr Meech said that he would do his best to work with tho other councillors, and thanked tbe Mayor for his kindly expression oi opinion. ORDINARY BUSINESS. Cr Black called attention to the unsightly feuce near the Bank of New Zealand. The Mayor said there was a good deal of water coming from the bank of clay where the street bad been recently widened. Cr McGregor moved and Cr Bruce seconded —■"■ That the owner of Section No. 32 be requested to comply with bye-law No. 15 in reference to the flow of water from that section on the footway." Car ried. On the motion of Cr McGregor, it was agreed to procure all the Acts of the General Assemblj** passed in sessions 1880 and 1881.

Seconded by Cr Bruce and carried. DESTRUCTION of trees. Cr McGregor said that trees were being destroyed in Aylmer street and up by Mr Checkley'e. He thought the police should have their attention cabled to the matter. The Mayor said it was a gross Vandalism. It was agreed that the attention of the police be called to the matter. GORSE ON ROADS AND OVERHANGING TREES Cr McGregor called attention to the gorse on Aylmer street that wanted realso to the trees overhanging Ppn'lguerie street. The latter were very ornamental, but would have to bo removed for the sake of utility, and due notice should be given. Ho only wished to see the matter in train. It was pointed out that there was no power under the Act. Cr McGregor said that he would look up the matter before next meeting, as the removal of the overhanging boughs was absolutely necessary. A GENERAL SCHEME. Cr Adams said tbat he thought such works as those in Balguerie street should not be considered by themselves but be part of one general scheme for the improvement of the Borough. The levels, etc., should be taken with reference to the rest of tho town. Cr McGregor said that the works in Balguerie street had been arranged in reference to a scheme for the improvement of the whole Borough. At the same time be perfectly agreed with what had fallen from Cr Adams. NOTICE OF MOTION. Cr Cullen moved tho notice of motion standing in his name as follows:—''That the resolution of the Council of January 19 be rescinded re the Town Clerk's bond, and the Clerk be requested to find security from a guarantee society for the stun of £100." The motion was agreed to after discussion and adjourned.
