AKAROA RESIDENT MAGISTRATE'S COURT.

Tuesday, August 30. i Brkork Justin Aylmick, Esq., R.M. civil CASE. Roberts v. Chappell, a claim for the sum of £15, half year's rent of section. Mr Henning for plaintiff and Mr Nalder for defendant. Tbe defendant pleaded that lie had already paid the amount to the late J. P. Roberts, husband of the plaintiff. Mrs Roberts gave evidence that there was no entry or memorandum of payment in any of the books or papers of the deceased, and that the money could not be traced. A. I. McGregor gave evidence as to the deceased being capable of transacting business on the day on which the money was said to have been paid. The defendant detailed the circumstances of the payment on the 27th December last, and that Mr Roberts promised to send a receipt on the following day by post. Mrs Chappell stated sh* was also present at the time of payment, and saw the money pass, and generally corroborated her husband's statement. Tbe Bench said the weight of evidence was in favor of the defendant, and gave judg'nient accordingly, with £1 ls solicitor's fee. The Court then adjourned.
