Before W. B. Tossy/ill, Esq., J.P., and His Worship the Mayor. civil CASUS. Arming v. B.echcr. In this case the defendant had sent a telegram to the Bench, asking for an adjournment. The case was accordingly adjourned till Tuesday, June 21. A. Sinclair v. Jules Lelievre.. Claim £3 13s 4d, balance of account for " tuition of children and labor." Mr Ileum ng appeared for plain till 1 and Mr Stringer for defendant. It appeared that plaintiff had entered into an arrangement with defendant, according to which be was to receive .-5.15 and bis board for six months' work, Al the expiration of a little ovgi- three months plaintiff took ill,.and bad to come into Akaroa to see Dr Guthrie. IJe was still ill. He had received some money on account, and now sought to recover the balance pro rata for the time be had served. Li answer to MY Stringer, plaintiff admil tec! the intention of bringing the case on again when defendant would not be represented by counsel. He would ask the Bench to dismiss the case. On reference to the Resident Magistrate's Act it appeared that the only course open to the Bench in tbe absence of the plaintiff was to strike out the case. Case struck out with costs, solicitor's fee £1 Is, and expenses £2 2s. Tho Court then adjourned.
