OKAIN'S BAY ROAD BOARD.

The usual monthly meeting of this Hoard was held on the above date in the Public Library, Okain's Buy, Present :— Messrs Mooro (Chninnan), Burnett, Oldridge and Bennett.

The minutes of the last meeting were road and confirmed.

The Chairman stated that no reply had been received from the Comity Council in answer to a letter scut requesting a grant of money.

The Chairman at,ked Mr Dalglish, who was present, what he intended to do about

the rent for the Lβ Bon's Bay jetty. Mr Dalg'i«h explained that he was quite willing to pay the balance due after tho wharfages due by Mr Smith had been collected by the Board. He stated that he had tendered for the lease of the jetty on Sept. 10, 1879, at £42 a-year, and his ten. dor had been accepted. H e had received the following letter : Bond Board Offics, Okain's Hay. September 28, 1879. Mr Jatnea Dalglish, Akaroa, •

Sib,—l have the honor to inform you that the Board have accepted your tender (dated 10th met.) of £42 for lease of Lβ Bon's Buy jetty. I will wait on you with a stamped agreement to that effect when you visit the bay .—I am, etc.,

David Wbight, Clerk. Ihe Into Chairman had given no instructions to the Clerk to carry this letter out, and no agreement had been signed. The jetty had been used by Mr Smith for six months, during which time probably 18,000 ft of timber a-week outward, and a large quantity of stores inward, would make the income about £80. Not having o legal right to sue for rates on account of having no agreement, he would be a loser if he now paid rent, and this through the Board failing to fulfil the terms of their Clerk's letter.

The Board thought that the tender wae as binding as an agreement, and that by paying the penalty for not having it stamped, it could he carried out.

It was then resolved—That Mr DalgHsh be asked to pay £20 for lease of jetty for past year.

Mr Dalglish considered the Board didn't look at the matter in the right light. Ho had been very particular in asking for an agreement, knowing how very uncertain

matters connected with the jetty were There was ft house and a crane on .the jetty, and he had no idea how he stood with regard to them, as it was a matter of opinion who they belonged to. The crane had since been removed, and it was to secure his light to claim, rates and dues that he had asked for an Agreement. No arrangement was made, so the mat-

tcr was held over.

Mr DalgliHlj had received a letter from the Koad Hoard, stating that his lease

had expired, mid that if he would make a reasonable offer for the jolty for the ensuing year, it would be accepted. Mr Dalglisli made an oll'er, but it must be accepted without prejudice to any further steps he might take.

Mr Oldridge considered that everything should be tendered fur.

Eventually the offer wns declined

Mr Oldridge asked the Clerk how Ion"----it was since he had written to the County Council about the Le Bon's Bay pound

books.

The Clerk stated that the letter was dated the 4th of October. No reply had

been received

Mr Dalglish asked what arrangements the Cierk of the Boar.i had made with the Clerk of the County Council. The Clerk stated that ho had seen the Clerk of the County Council at Lβ Bon's Bay, and had been infoimed by him that a new table of fees would require to bo erected. He had replied that the Road Board bad no funds to do so. The Clerk of the County Council said that they

would procure one, and said he (Mr

Wright) might bring it over when it wae painted. He therefore agieed to do bo, but, in the belief it was a small one ; ho was afraid ho would not be able to do so now, on account of its size.

The opinion of the Board seemed to be that the County Council had no right to take over the Le Bon's Bay Pound* The Okain's Bay Road Board had paid for its erection, therefore it should derive any benefits accruing therefrom.

The following accounts were passed for payment:—G. Bis £4 3s, J. Harris 14s, J.

Karalus £418s, Shuttleworth £1 10s, Jas. Waghorn £1 12?, W. Ashton £4, do (con-

tract) £24, D. Wright £10 3s, Welle £3, A. Leonardo £1 10s, H. Elliott £3.

A message was received from Mr Ilewer asking if the Board required a ranger.

A reply in the negative was directed to be sent. •

The original plan of drawing lots who should be sued for unpaid rates was abandoned, and the first five on the roll in each bay were taken, five more to be sued the following week till all arrears are paid up.

The Board then adjourned.
