AKAROA AND WAINUIROAD BOARD.

; The Board met in their new office, Head of the Bay,- on the above date. Present — Messrs Williams, M'Donald, Curry, and Shadbolt. I Tn the absence of Mr Duxbury, the Chairman, Mr Williams was voted to the chair. The minutes of the last and adjourned meeting, also of the special meeting, were read and confirmed. < DEPUTATIONS. A deputation, consisting of Messrs Kingston, Brown, and Sager interviewed the Board with reference to carrying the Robinson's Bay Valley road further up the valley, so as to be of use to those holding land on the upper part of the valley. Mr Sager explained that about 500 acres of land in the direction mentioned were without any sort of road, and that the cost of constructing one would be but small. At this stage, Mr Brown, a member of the deputation, stated that ho objected to the road going any further than his property, and indeed would not allow it. The Chairman explained that the question of allowing it had been taken out of his hands by " The Public Works Act.". Mr McDonald said it wa9 useless for them to come to the Board unless they were all agreed on the matter. Mr Shadbolt snggested that the En- | gineer should be asked to lay oi? the road, and the deputation, after seeing the line could then come to the Board. The Chairman said he was afraid the road would cost a considerable sum. and he thought that if they got a road as far as the reserve, it would answer all purposes. He was not in favor of employing their Engineer in the way suggested. What those interested should do was, before coming to the Board, to sign an agreement that they would give the land required at a fair value, but above all, they should be unanimous in the matter. The deputation then withdrew, for the purpose of agreeing and corning before the Board again. OKAIN'S BAY EOAD DIVERSION. Mr Martindale waited upon the Board with reference to the proposed diversion of the Okain's Bay road from where it leaves Mr Piper's property to its junction with the main road at Seafield. Mr Martindale put his otter in writing, viz., that he did not wish to sell any of his land, but would take land for land, as shewn on the Engineer's plan of the diversion, and in view of the land he would enclose being 22 perches larger than what he gave, would do the fencing himself, with the exception of 4 chains 90 links along the present Okain's road, which he would erect at 25s per chain. On the motion of Mr Curry, seconded by Mr McDonald, the offer of Mr Martindale was accepted. "begtjlation of local elections act 1876." A letter was received from the Colonial Secretary, covering a copy of the New Zealand Gazette of 6th August instant, and drawing attention to the Governor's proclamation at page 1100 of same, that the " Local Elections Act, 1876 was now in force in the Akaroa and Wainui Road District as regards all elective offices. ENDOWMENT OF EOAD BOARDS. The following letter was received from Mr Montgomery in reference' to this subject — ""'''' ' ' ' ' : " Wellington, August 10, 1878." ■" h'ave.tho honor to acknowledge receipt of a.number of letters from various Road Boards, approving of the proposal which emanated from your Board respecting endowments.. ■ -..• , . . -.•... "'TTiis question'has'been brought before' the Assembly on two occasions, and on each the Government declared that they did not intend to bring in a Bill or support i any measure having for its object the granting of endowments. It is probable that a resolution respecting endowments may be moved by some member. Do you recommend any particular course of action ? . . . " W: Montgomery. •' Clerk to the Akaroa and Wainui Road Board." 'The Board unanimously agreed to leave the matter entirely in Mr Montgomery's hands to do what he considered best in the matter. Letters were also received from the following Road Boards on the same subject, and approving of the principle of endowments, viz., Hawkesbury, Wairauku, and Waikouaiti. i KENNY'S LONG BAY CONTRACT. The Engineer's final certificate for this I contract was read as follows : —"That the j road has been taken possession of by the ! residents in the district and it would j hardly be fair to make the contractor reI pair any injury that may have been caused Iby .j tho traffic. ' The road however, notwithstanding the carting over it is in good | order." NEW WOfiKS. The Engineer wrote enclosing plans and specification for the Okain's Bay road upper part from Mr Piper's property to Kenny's old contract, 22 chains. Also, specification of the upper part of the Mount Bossu Read. Tenders havo been already called for the first work, the Clerk was instructed to call tenders lor the latter. - solicitor's couit espondence. - Mr Nalder wrote, stating that he had not been supplied with the plans and description of Mr, Eugene Lelievre's land hence the delay iv preparing the conveyance. The Clerk explained that this had since been furnished.
Mr Nalder also wrote, handing the conveyance of land taken for road diver-, sionfrom MrF. W. Moore, D. Le Vaillant, and Mr Morgan, and also conveyance of Mr Waeckerle's corner at .end .of Lavaud street Akaroa, and advising 'that the remaining deeds Avere in the hands;of the Registrar and would be handed to the Board as soon as registered. MAINTENANCE OF MAIN ROADS. The Chairman of the County : Council advised the Board that he had; in terms of their request, to submit the question between this Board and the Little River Board as to the maintenance of that part of tbe main road from Barry's Bay Saddle to Red John's gully, pursuant to the terms of " The Public Works Act, 1876," appointed Thursday, the *29th instant, at 2 p.m ,at the Council's meeting at the Hill Top, to hear the parties from.each Board. Mr Shadbolt proposed thatthe Chairman, Mr Dttsbury,' and Mr F. W. Williams be requested to attend and represent this Board on the occasion. Seconded by Mr S. Curry, and agreed to. PROVINCIAL LIABILITIES. In reply to a request from the Board, asking the amount of his claim for land taken for a piece of road by the late Provincial Council, Mr Latter stated that he could not now submit the. question to the Government, as so long a time had elapsed, and further, that if the Board did not settle the matter Avithin a reasonable time, he would close the road
The Chairman remarked that he did not see'how Mr Latter would prejudice any claim he might have by giving the Board any data he waa possessed of to the better enable the Board to claim ori the Government. He had little doubt all the claims of this sort would in the end be required to be settled by the' Board, and as they had no knowledge of what were tho original terms on which the road diversions were carried through by the late Provincial officer, the Board had rather a difficult task before them. Mr H. Piper wrote in answer to the Board re compensation, that he bad originally agreed to submit the matter to arbitration ; he had been paid for between 40 and 50 chains of fencing, and would be willing to arrange the matter of compensation by the Board conveying to him the two straight roads running from the Okain's road to the Valley road, nnd that part of the old Okain's road between his land and that of Messrs Duxbury And Brown. Mr H. Piper further replied, that if the Board accepted this offer it would save the district from £100 to £140 in fencing. Mr A. C. Knight, Tikao Bay, m reply to the Board's inquiries, replied that he did not know the Provincial Government in the matter, he had purchased the road now used Avith the rest of the property ; he reminded tho Board that he had writteu to them on the 13th November last, offering to give up the new road for certain unused and impracticable roads, being Avilling to pay, or be paid, at the rate of £10 per acre for any difference of acreage, and he now wished A definite reply. Mr Knight wrote as follows:— " That offer being at an end, and as I do not Avhich to inconvenience the public by stopping the road, I will iioav make a similar one, that ia to say I am willing to sell my private road, which is now being used by the public, taking in .exchange the old ono so far as it runs through my land, and the road between the old and the new one, forming part of the northern boundary of section 8459, and the road marked on the map as being between my sections 5587, 20,880, 11,284,' 19,834, 11,286, 11,277, 11,285, 15,584, 19,910, and the road marked on the map as forming the southern boundary of my section 11,286, any difference in the acreage to be paid by your Board, or myself as the case may be. at the rate of £10 per acre. I may state that the roads I propose to take in exchange are timbered and unused, and as shewn on the map, never can be used. The Chairman said the question was» did the closing of these roads affect the district, and further suggested that Mr Knight should be asked if he would object to giving Mr Bates a good road to his property on the same terms in lieu of the one proposed to.be stopped. It Avas ultimately resolved to hold over the consideration of the three letters to a full meeting of the Board, as well as a letter of Mr E. Chappell's offering to take £40 or 20 acres of land for a claim of a like nature.. The Board had been informed that Mr Chappell's land was subject to roads, and nusurveyed at the time his claim was dated fiom, and instructed the Clerk to make inquiries on the subject, and ascertain from Messrs Brown and Duxbury if they objected to Mr Piper's proposals. ONUKU EOAD. Mr A. Hawthorne applied to the Board to assist him in making a branch road from the Onuku road to his property, and also inquired if Mr Glynan had the Board's permission to close up part of the old Onuku road. He also made a complaint as to the Clerk's measurement of his fencing. ' The Clerk was instructed to state in reply that they could not give assistance to make roads over private lands, and that the Board had given no permission to close the road referred to. The Clerk was instructed to procure a new chain, and in futnre measure all work by chain, instead of a tape. CULVERT IN BARRY'S BAY. Mr Le Clerc Avrote, requesting the Board to put in a culvert across the Barry's Bay road, opposite Perhara's property, occupied by him. The Clerk stated the work waß necessary, and he Avas directed to have the work done as soon as pipes are to hand.' GERMAN BAY ROADS. Antonio Koloski requested the Board to form a road to his section in German Bay, and also asked where the proper road was at In man's woolshed. Mr E. Harrington requested to be informed Avhether the road in German Bay flat Avent above or below the woolshed, as settlers had been informed by Mr Duxbury that they were trespassing, and' also asked the Board, to form two more chains of road up to his house. The Clerk Avas instructed in both cases to visit and report on the roads, and also find out the correct line of road at the Avoolshed, and report to next meeting. Mr R. DaAvber complained of the bad state of the road on the flat from the beach to the main road being cut up by. carting metal on it. . The Clerk was instructed to employ Mr Hammond* and have the work done at I once. 'I
BOAD DIVERSION, DUVAUCHELLE'S BAY . CEMETERY. Mr- Thomas Brooks, as Chairman of the • Cemetery and Recreation Ground Com- -' mittee, Avaited upon tlig Board, and on bethalf of his Committee offered the land required«by the Board and as set out in their Engineer's plan, for Okain's Road to Main road, along with the piece se\*ered, in all " 1 acre and 32 perches, for the sum wf £100, the Board fencingthe same, and paying all charges of surveying and conveying, &c. The Chairman thought it was the best thing they could do to accept the Committee's offer. If it was put under the Act the cost would be as much if not more. Mr McDonald had no idea land was so valuable in that part of the Avorld. The groundf had not heen taken possession of in any way, or improved by the Committee, and the advance in price since the . date of purchase was very consider- »■■ able. If as waa stated this Avas the heat ' they could do he would propose that tho offer be aecpted. Mr Curry seconded tbe proposal, which was unanimously'agreed to. MOUNT BOSSU SPECIAL GRANT. Mr Curry said he could not quite understand the reply of the Chairman of the ' County Council's letter of the Ist instant, being an answer to the Board's request to have the grant of £1549 14s paid to t&e - credit of .the Board that the work was in hand. Sunclllf|,jA and J. Glynan's roads Avere left over for consideration at the nest meeting. INSTRUCTION TO ENGINEER. Mr McDonald moved that in future the the Engineer b« instructed in all cases when surveying roads to put the fencing pegs in at the same time as the centre pegs, and that before leaving the Wainui side Mr Fenton be requested to re-survey the line of road through Mr Knight's land, and the Native reserve for conveying and fencing purposes. The Clerk was asked to learn from Ihe Engineer when he expected to have tho plans and specifications of tbe road through the Plead of the Bay Cemetery ready. Tenders. clearing bush, old frbnch farm road. T. Brough and Co., seven weeks, 15s per chain—£44 ss. T. 8. Baker, one month, 16s per chain. W. Wright, six Aveeks, 15s per chain— £44 ss. J. Sandrigan and Co., three months, 18s per chain—£s3 2a. Mr Shadbolt moved, seconded by Mr M'Donald, that W. Wright's tender be accepted. Carried. «$ UPPER PART OKAIH'S BAY ROAD. *** P. Shadbolt and Co., two months, £2 15s per chain, £60 10s ; catch water drains, 7s per chain, £7 10s; culverts, 4s 6d per foot. . W. Kenny, six weeks, £2 ,l7s 6d per chain, £57 10a; catch water drains, 12b 6dr~" chain ; culverts, £4 each. Mr M'Donald moved that Messrs P. Shadbolt and Co.'a tender be accepted, remarking that there must be some error in Kenny's lump sum. Seconded by Mr Curry, and carried. * PAYMENTS.
