Evidence taken under "The Resident Magistrates' Evidence Act, 1870." Mr Nalder for plaintiff. Mr Joynt for defendant. Henry Burgess Lane, examined by Mr Nalder, sworn : I do not know George Brough. I had a deal with Perham for horses. I recollect exchanging my bay mare for his brown gelding. No cash was given on either side. I did not give Perham £14 for the brown gelding. This was the only transaction in horses that I had with Perham. He did not say to whom the brown gelding belonged, and did not say whether he was making the exchange for himself or any one else. I cannot say whether my mare was in foal when I exechanged. I exchanged her because she was lame. I can't say whether there is a brand on the gelding, nor can I possibly say there is one on the mare ; I don't think there is. I don't think Perham told me where the gelding came from.

By Mr Joynt: I recollect the transaction perfectly, that is, the exchange at last. I don't know whether £14 was,put as the value of the mare. The lameness of the mare was spoken of at the time of the exchange. The mare was plainly lame at the the time. I have an idea that Perham said he wanted the mare for breeding purposes. I cannot say whether Perham offered to buy the mare before the exchange was made. I can't recollect any such price as £14 being put on the brown gelding.
