AKAROA RESIDENT MAGISTRATE'S COURT.

Friday, Nov. 30. (Before His Worship the Mayor, arid G. H. Saxton, Esq., J.P.) Civil Cases, t. hicky v. m. r. ashwin.

Mr Nalder appeared for the plaintiff. In this case the plaintiff sued defendant for £14 14s, being amount of wages due. .The defendant stated .that the case had arisen out of "at former judgment delivered at this Court, whereby he (defendant) was macle to pay for the damage done to a cow, the property of Mr Mclntosh, by the plaintiff, who was putting up a fence for him at the. time, and who caused the stone to roll "down the hill, thus injuring Mclfltosh't cow. He had offered the plaintiff his wages, less the amount, for damage, but he had refused to take it. Judgment given for amount claimed, with, costs. ■ ••.."■■' M. E. ASH WIN v. T. HIOKY. . This was a cross-case, in which the plaintiff sued "for the amount of -damage

to the cow previously paid by him, namely £10. . Mr Nalder for the defendant. After hearing the evidence, which was the same as given in the former case, it having been shewn that the defendant had used all proper /care and precaution when executing the work for the plaintiff, and during which the damage was done, being the result of a pure accident, the Bench decided that the defendant, as an employee, was not responsible for damage done, and gave judgment for defendant, with costs. . The Court then adjourned.
