AKAROA RESIDENT MAGISTRATE'S COURT.
Friday, August 3, 1877. (Before Justin Aylmer, Esq*, R.M.) Civil Gases. Hawthorne v. brown. In this case the defendant was charged with having used threatening language against the plaintiff. The evidence went to show that the plaintiff had. gone upon defendant's land for the purpose of ascertaining a true estiriiate of the amount of some timber, concerning which a previous case had been heard at this Court, with a view to offering the defendant, the, royalty for which he (defendant) claimed the timber. That the defendant who was owner of the land, warned the plaintiff off and -threatened to damage his cranium and finish up by precipitating him into a-creek should he trespass there again. The Bench dismissed the case as trivial, .. .HAWTHORNE V. J. PORTER JNR. . This case arose out of the prevous one. The defendant.did not deny having threatened the plaintiff, when telling him to leave the place. , The Bench • .considered the defendant, being a minor, and not owner of the land, had nothing" whatever to say in the matter, and therefore fined him ten shillings and costs. ~ ..'.'* ;:'.: The Bench declined to interfere in any way in the matter of the royalty in. the timber, advising plaintiff to take legal advice. • PAVITT V. THACKER. Judgment, which had been reserved from last Court day, was now given in this case for amount claimed £40 7s, with costs ££3s.
