This was a claim to recover the sum of £2 Gs, for wages, in lieu of a weeks notice, A great deal of evidence was led in this case by the defendant to shew that the plaintiff used a quantity of flour that he was instructed not to us&, as being unfit for baking purposes. The Bench held that the plaintiff, as a servant, had not taken sufficient care in the carrying Out of his duties, and that the defendant was entitled to dismiss him without notice. Judgment for the defendant, with costs. B. DAWBER V. B. CHAPEL. This was a claim to recover the sum of £1 10s, being special education rate for German Bay district. The defendant pleaded that the property in which the rate was levied, was beyond the three mile radius. The question was simply of boundary. A part of the defendant's land was proved to be within the radius as gazetted. Judgment would be for the plaintiff, with costs. J. B. GILLIAT V. G. R. JOBLIN. Claim for £26 2s 2£d, being share of dividing fence. The plaintiff produced his Crown grant, showing that the fence was in its proper place. This was denied by Mr Joblin, who had evidence to show that the line fenced by the plaintiff was not the one originally laid out by the. Government surveyor. The Bench said it was pretty much a question for experts, and reserved judgment till the 31st inst , , when a Court would be held at Little River.
