After hearing evidence and argument by counsel, His Worship nonsuited plaintiff on the ground that the valuation was made under the the "Gold Duty Abolition and Mining Property Rating Act." Alleged Assault. D McOonnocbie v. M McCarthy. Complainant charged defendant with unlawfully assaulting him on the nieht of July 26th, at Earnscleugh. Mr Hutton appeared for complainant, and Mr Bartholomew for defendant, who pleaded " Not Guilty." Evidence for the prosecution ma given by W McTaggart, A King, W Wilson, and by complainant, It was alleged that defendant had assaulted complainant by forcibly ejecting him from Wilkinson's house, where the partes had met, and then striking him ; mlso th t subsequently defendant had further assaulted complainant while on his road home by striking him with a stick.

The evidence was somewhat (Jonfiiotrog as to the nature of the sssault. Defendant, in his evidence, denied that he had assaulted complainant in the manner alleged, or that he had used any unnecessary violence.
