John Kent was ' brought before Dr Giles, B.M, charged with a breaoh of tbe railway regulations by climbing over a fence enclosing the railway platform at Ellersiie Racecourse, thus evading payment of fare, and obstructing J, W. The offence was committed at Ellerelie on Boxing Day, and is a common one on race days, numbers of people jumping tbe barriers when the train draws up at the racecourse platform, it beiog thus impossible to collect their railway tickets. . His Worship said he did not think defendant obstructed the officer by merely climbing over the fence. Mr Tbeo. Cooper, who appeared for the Railway Department, urged that this constituted passive obstruction, as the officer was thereby prevented from collect* ing defendant's ticket.
