* [per press association ] Wellington, Augustus. In the Supreme Court this afternoon, tho case H R. S aple'on v J. Smith) claiming £600 for »illoged ma'icious prose cutioa, was heard. Plaintiff, a draper^ assistant was formerly erap'oyed m Te uo House, owned by def ndant, and the later, missing an umbrella, charged Stapleton with having it m his possession, and obtainad a search warrant against him The evidence showed the umbrella had baen purchased at a clothing establishment m Wellington. No evidence was called by defendait, who paid £25 into court as ample compensation. After twenty minutes' discussion the jury returned a verdict for £500, costs being fixed according to ectle. An applies' ion will be made to slay execution, as it is intended to move for a new trial on the grounds that the damages are excessive.
