A set-off had beea filed to which Mr Cuthbertson objected on the ground of its not having been filed In the time specified by Btstute, and, furthermore, he contended that the Bet-off should be the eubjeot of a separate aotlon, as it was a claim for damages, and the. law was very olear on this point.— The Bench said they would oonslder the point raised later on.— The plaintiff said that he had been engaged by defendant to work at a threshing machine at 10j per 1000 bushels and pay his own keep. In consequence of wet weather the farmer would not allow the machine to work and plaintiff left.~The defendant and a witnesi stated that defendant had been pot to a great deal of inconvenience through plaintiff leaving without notice, and they further Baid that through plaintiff's action two other men left. There had been no arrangement as to notice. — The Benoh were of opinion that plaintiffs conduct In leaving without notice wbb very reprehensible, and they would only allow judgment for 15s without coats. They were of opinion that defendant had naffared loss through the plaintiffs behavior, bat It would ba for him to bring his claim In the ordinary way. Baylia v B.
