His Honor the Chiei Justice and Mr Justice Richmond presided at the sitting of the Court of Appeal to-day. A motion on the part of the Crown to set aside the award of the Compensation Court at Ashburton, granting £1252 and costs to Allan McLean In respect of land taken for the purposes of the Ashburtou-Mount Somers railway was allowed with coats, Mr Juatice Ward dissenting. Mr Gully who acted for Mr McLean intimated hia intention of applying to the Chrlatchurch Supreme Court, from whioh the motion had been referred, for leave to appeal to the Privy Council .
