The defence was a denial that defendant was a shareholder of the Comp-tny, that he had been induced by misreprtsen'ation to take np 250 Bharea, but had sent m notice of withdrawal. He bad neither accepted the articles of Association nor paid call?. For the Company It was contended that the misrepresentations were not material, and tho letter of withdrawal had never been received. M-: Justice Ward decided m favor of defendant ; coats on the loweit eoolo.
