PATENTS, DESIGNS, AND TRADE-MARKS. FORTIETH ANNUAL REPORT OF THE REGISTRAR.

Presented to both Houses of the General Assembly 'pursuant to Section 128 of the Patents, Designs, and Trade-marks Act, 1921-22.

I have the honour, in pursuance of section 128 of the Act, to submit my report on the operations thereunder for the past year. A total of 3,434 applications for grant of letters patent and for the registration of designs and trade-marks was received during the year. A slight increase is shown in the case of patent and design applications, while a decrease has occurred in applications for registration of trade-marks, 124 less being received than in 1927. The number of applications for patents received from countries beyond New Zealand shows a satisfactory increase, 1,040 being received during the year, as compared with 871 in 1927. This figure is also 190 in excess of the average number of applications from overseas for the years 1922 to 1927 (inclusive). Applications for patents by applicants resident in New Zealand totalled 1,032. The total revenue of the Office for the year in respect of patents, designs, and trade-marks was £13,302 10s. lid., being an increase of £660 Bs. sd. over that for 1927, and the highest yet received for any one year except 1925, when the receipts from all sources was slightly in excess of that for 1928. The surplus of receipts over payments for the year amounted to £7,931 Bs. Id., an increase of £676 12s. Bd. over the surplus for the previous year. The expenditure, which has been carefully controlled, totalled £5,371 2s. 10d., a figure which compares favourably with those of former years. The total surplus of receipts over expenditure since the Ist January, 1890, is now £150,029 19s. 7d. Comparison of Number op Letters Patent issued and Registrations op Trade-marks and Designs effected in New Zealand and other Convention Countries. The number of letters patent sealed and the number of designs and trade-marks registered in New Zealand, form the subject of an interesting comparison with corresponding activities in other States belonging to the International Convention for the Protection of Industrial Property. The information set out below is published in the issue for January, 1929, of La Propriete Industrielle, the official organ of the Union, the numbers given immediately after the names of the countries being for the year stated, while the number of transactions for the previous year is shown in parentheses. Referring first to letters patent, the United States of America heads the list for 1927 with 42,057, as against 45,025 for the preceding year. In the matter of designs, Switzerland continues to leave all the other countries behind, with 217,750 registrations for 1927, compared with 202,142 in 1926. With regard to trade-marks, the United States of America leads with 17,649 registered marks, as against 19,246 in 1926. Patents. During the year 2,070 applications for patents were received, as compared with 2,052 in 1927. Of this number, 1,032 (1,147)* were lodged with provisional specifications, and in 1,038 (905) cases the application was accompanied by a complete specification. There were also lodged 308 (301) complete specifications in respect of applications for which a provisional specification had already been filed. The total number of applications received up to the 31st December, 1928, was 6.1,885, and the number of patents in force as at that date was 7,718, made up as follows : Patents sealed and third-year fees paid from the 31st December, 1925, to the 31st December, 1928, 3,369 and 1,870 respectively; sixth-year fees paid from the 31st December, 1918, to the 31st December, 1928, 2,478 ; and one seventh-year fee. Patent fees received during the year amounted to £9,615 Bs. 9d., being an increase of £554 ss. 6d. over the corresponding amount for 1927, and the highest amount received in any one year, with the exception of 1922, when the patent receipts totalled £9,819 18s. 6d. The restoration of lapsed patents to the register was effected in 6 (6) cases, and 2 (2) patents were sealed after the prescribed time. The fees from these two sources amounted to £125 10s. (£l7B 10s. 6d.). Under the provisions of the Amendment Act of 1924, 3 (5) patents were endorsed " Licenses of Right," and in 1. (0) case an application for patent was accepted after the prescribed time. The Supreme Court was applied to in three cases to extend the term of letters patent under section 20 of the Act. In two of these proceedings an extension of seven years was granted, while the remaining case was withdrawn. It will be noticed that there has been a considerable increase in the number of inventions recorded in the class relating to telephony and telegraphy (including phonographs), chiefly in connection with wireless systems, picture-transmission, talking motion pictures, &c. Increases have also taken place in the classes relating to cultivating, 40 (36) ; boxes, cans, and casks, 89 (71) ; harvesting, 24 (15) ; indicating, &c., 74 (65) ; wearing-apparel, 44 (39) ; and budding-construction, 115 (106). There has been a further decline in the number of applications received in connection with milking machinery, 33 (42), and a slight fall in the number relating to dairying, 43 (51), while not much change is involved in other directions. Designs. Applications for registration of designs for the year under review numbered 163, being a slight increase over the number for the previous year (145). The number of applications received from persons resident in New Zealand was 107 (93) ; 33 (38) applications Were received from Great Britain, 12 (7) from Australia, 3 (0) from Canada, 5 (4) from the United States of America, 2 (3) from France, while 1 (0) was received from Switzerland. It will be noted that the majority of applications were lodged by residents in the Dominion, little advantage being taken of design-registration by applicants living in foreign countries or in other parts of the Empire.

The first term of design-registration lasts for five years, and, though the protection may be renewed for a further term of five years, only a. comparatively small number of such renewals is effected. A further extension of five years, making fifteen years in all, may be applied for, but the number of such applications is almost negligible. The total number of applications up to the 31st December, 1928, was 2,695, and the number of registrations in force on that date was 860. During the year there were 55 extensions for the second period and 2 extensions for the third period. Trade-marks. The fees received during the year in respect of trade-marks amounted to £3,461 16s. Id., being a slight increase in the amount for 1927, in which year £3,370 17s. was received. The applications lodged for the year totalled 1,201, as against 1,325 in 1927, the number in that year being the largest number received in any one year, with the exception of the years 1920, 1924, and 1925, when there were 1,391, 1,338, and 1,332 respectively. The applications received from persons residing in New Zealand numbered 477 (460). Residents in Great Britain lodged 316 (284) applications, and 206 (189) applications were received from the United States of America. Applications from the Australian Commonwealth were as follows : New South Wales, 68 (66) ; Victoria, 26 (66) ; Queensland, 2 (0) ; South Australia, 2 (1) ; Tasmania, 2 (0). There were 11 (10) from Canada, and 54 (202) from Germany. The number of applications received up to the 31st December, 1889, was 1,213. From that date to the 31st December, 1928, 27,217 applications were lodged, making a total of 28,430. Applications were greatest in number in the following classes of goods : —" Substances used as food or as ingredients in food " (Class 42), 181 (203) ; " Articles of clothing " (Class 38), 101 (115) ; " Candles, common soap, detergents ; illuminating, heating or lubricating oils ; matches ; and starch, blue, and other preparations for laundry purposes " (Class 47), 87 (76) : " Chemical substances prepared for use in medicine and pharmacy " (Class 3), 82 (67) : " Machinery of all kinds and parts of machinery, except agricultural and horticultural machines included in Class 7 " (Class 6), 67 (35). Patent Agents. No names were added to the register during the year. The total number of names on the register as at 31st December, was twenty. Conclusion.
