NATIVE LAND COURT (JUDGMENT OF THE CHIEF JUDGE OF THE), UPON THE TAUMUTU NATIVE COMMONAGE RESERVE, DELIVERED 27th NOVEMBER, 1906.

Return to an Order of the House of Representatives dated the 16th October, 1907. " Ordered " That there be laid before this House the report of the Chief Judge of the Native Laud Court upon the Taumutu Native Commonage Reserve, stating the names of the persons thereunder recommended to be included therein as owuers, and the relative shares awarded to etch person respectively." —(Mr. Pabata.) TAUMUTU NATIVE BESEEVE. Judgment of Chief Judge Jackson Palmek, delivered 27th November, 1906. In deciding this case the Court has to look at the position as it was when the land was set aside for the Natives, and also the slight modifications of that position by deaths and other matters at the date of the hearing. The Court has gone carefully through the original lists made by Jucke Mackay and heard objections thereto in open Court. Several lists of names for inclusion were handed m and read out ana objectors challenged. The Court, after considering the whole matter, has decided that the beneficial owners of the said land are as set out in the schedule hereunder, together with their respective interests In arriving at the relative interests the Court has been guided by the principle of allowing one interest for the father of a family who was entitled to go into the title, one interest to the mother ot a family who was entitled to go into the title, and one interest for the family if there were then any such family entitled to go into the title. Where there were no such family interests in issue the Court had to adjust the relative interests as near as possible to the above principle

With regard to compensation claimed by Taiaroa's estate under section 6 of " The Taumutu Native Commonage Act, 1905," the Court personally inspected the block, and, after due consideration, and having the Government's valuations as to improvements before it, considers that in equity Taiaroa's estate should receive compensation for the lease over this land which is terminated. The amount we assess as such compensation is the value of the improvements effected upon the land—namely, £58. Jackson Palmek, Chief Judge, Native Land Court.
