1903. NEW ZEALAND.
NIGHTCAPS COAL COMPANY'S RAILWAY BETWEEN WAIRIO AND NIGHTCAPS (AGREEMENT FOR WORKING).
Laid on the Table of the House in pursuance of Section 43 of " The Government Railways Act, 1900."
Agreement. This deed, made the twenty-seventh day of January, one thousand nine hundred and three, between the Honourable Sir Joseph George Ward, K.C.M.G., Minister for Railways (who, with his successors in office for the time being, is hereinafter referred to as "the Minister"), of the one part, and the Nightcaps Coal Company (Limited), carrying on operations at Nightcaps, in the Provincial District of Otago (who, with its successors and assigns, is hereinafter termed "the Company "), of the other part, witnesseth that, in consideration of the several premises, and in pursuance of the powers conferred by "The Railways Authorisation Act, 1894," and "The Government Railways Act, 1900," the Minister doth hereby stipulate and agree with the Company as follows :— 1. The Minister shall run the Government trains on the Company's railway from Wairio to Nightcaps, and do all things necessary for receiving, carrying, and delivering passengers and .goods thereon. 2. The Minister shall be entitled to retain all rates, fares, and other charges for all services performed in and about the said railway in connection with the receiving, carrying, and delivering of passengers and goods thereon, except so far as is hereinafter specified, and, in consideration of the premises, shall maintain the said railway in good order, and pay to the said Company a sum not exceeding thirty pounds (£3O) per annum, payable half-yearly on the thirty-first day of March and the thirtieth day of September in each year, the first of such payments to be made on the thirty-first day of March, one thousand nine hundred and three. 3. The Minister shall make a terminal charge of two shillings and sixpence (2s. 6d.) per ton on all coal received at the public sidings of the Company's railway at Nightcaps Station and carried on the Company's line, in addition to the ordinary gazetted charges, and shall pay over such terminal charges on coal to the company from time to time. 4. This agreement shall continue in operation for a period of three years from the thirteenth day of December, one thousand nine hundred and two.
