AGREEMENT WITH T. COOK AND SONS, TOURIST AGENTS (COPY OF).

MEMORANDUM OF AGREEMENT, made and entered into this second day.of October, 1888, between the Minister of Public Works for the Colony of New Zealand (hereinafter referred to as " the Minister"), acting for and on behalf of Her Majesty the Queen, of the one part, and Edward Ernest Bilbrough, of Auckland (hereinafter referred to as "the Agent"), acting on behalf of Messrs. Thomas Cook and Son, Tourist and General Passenger Agents, Ludgate Circus, London, of the other part. 1. The Minister and the Agent hereby agree that the Agent shall be at liberty to act in procuring tourists from other countries or colonies to travel on the Government Bailways in the Colon)' of New Zealand, at the remuneration and subject to the conditions herein contained. 2. Tourists resident in other countries or colonies, who are travelling in New Zealand, may be supplied by the Agent with coupon orders, issued by Messrs. Cook and Son, in such form as may be agreed upon between the Minister and the Agent, and such tourists shall be entitled to receive in exchange for such coupons, for their personal use on the New Zealand Government Bailways, the sectional tickets described and enumerated in the Schedule " A " hereto subjoined, and subject to the conditions and limitations therein set forth. 3. The Agent shall cause to be advertised at all Messrs. Cook and Sou's offices, in countries or colonies other than New Zealand, particulars of the arrangement made herein, and of the facilities afforded to tourists travelling upon the New Zealand Government Bailways, and shall exhibit such notices of the New Zealand Railways at their said offices as the Minister may from time to time request. 4. The Minister shall pay to the Agent a commission at the rate of ten pounds (£10) per centum on the value of all sectional tickets issued by the Minister in exchange for the coupon orders of Messrs. Cook and Son, granted in accordance with the provisions of this agreement. 5. The Agent shall supply the Minister with the names of his authorised agents, or of the other authorised agents of the said Messrs. Cook and Son in the colony, and with such samples of complete coupon-books, and of the signatures and stamps of such agents respectively, as the Minister may from time to time require for distribution to the several railway-stations. 6. Payment for the tickets issued in pursuance of these presents, shall be made four-weekly by the Agent to the Minister, at the full fares specified in Schedule " A" hereto, on receipt of particulars from Eailway Accountant, Wellington ; and commission on sales will be paid to the Agent four-weekly from Wellington. 7. The Agent shall give security to the satisfaction of the Minister for the due payment of all claims for tickets issued by tho Minister on the orders of Messrs. Cook and Son; and shall also give security against any of his agents, or the agents of the said Messrs. Cook and Son, issuing coupon orders to any persons resident in the Colony of New Zealand, and not being bona fide travellers through the colony. 8. The Agent shall record the names and addresses of all persons to whom coupon orders are issued, and also the names of the steamers by which such persons have arrived in the colony, and the date of every such arrival; and shall afford the Minister and the officers of the Working Railways Department throughout the colony access to such record at any time when demanded, and shall also give all information respecting such persons and such record a s the Minister or any person duly authorised by him may demand. 9. This agreement shall be terminable upon the expiration of six months' notice in writing in that behalf, given by either of the parties hereto to the other of them. 10. And it is hereby expressly agreed and declared that these presents are made subject to the provisions of "The Public Works Act, 1882," and the several Acts amending, the same, and to the railway by-laws and regulations duly made in accordance therewith. In witness whereof the said parties hereto have hereunto set their hands the day and year first above written.

Separate railway tickets for each journey indicated in the schedule will be issued, upon presentation and in exchange for Messrs. Cook and Son's coupon orders, to tourists resident in other countries or colonies who are travelling in New Zealand. Tickets from any starting station will be issued only at that station. The coupon orders must be presented in the block; detached coupons will not be honoured. The coupon will be detached by the station clerk. Each coupon order must have the. name and address of the person to whom issued. It must have the date-stamp and signature of the local agent, showing when issued to the holder. No tourist shall be entitled to draw more than one sectional ticket for the same journey during the same visit to the colony. _ The tickets are not transferable. Holders of sectional tickets may stop over at any intermediate station within the time for which the tickets are available. The Minister does not guarantee the operation of the fares over the Wellington and Manawatu Company's line, except so far as may be agreed upon from time to time between the said Company and the Agent. Coupons issued under this agreement will not be available unless used within three months from date of issue.
