Memorandum of Arrangement between the Wanganui Heads Eailway Company and the Minister for Public Works for the Despatch of Passenger Trains from the Wanganui Station on the Company's Line, and for the use of Government Stock, &c. The company may, at times to be determined upon by the District Traffic Manager, be allowed to start its trains from and to run them into the Wanganui railway-station platform. When within the limits of the Government railway the company's servants shall be under the orders of the District Traffic Manager, and shall obey him or any other Government officer or employe acting under him or in his ordinary capacity in connection with the working of the railway, and they shall be subject to the by-laws, rules, and regulations in force en the New Zealand railways. All acts performed or work done by the Minister, or persons engaged by the Minister, for or on account of the company, in dealing in any way with the despatch or arrival of trains from or at the Wanganui station, shall be so done or performed at the sole risk and expense of the company; and the company shall pay all claims for personal damages, or for damages arising from loss of goods, or injury to property of any kind, which may arise in connection with the company's traffic. Should the company require it, the Minister will supply the company with such labour, clerical assistance, stores, stationery, and tools, as far as the Minister can conveniently do so, and at his option, charging the company for the same. Upon twenty-four hours' notice in writing from the company the Minister will supply a locomotive engine complete, with labour and stores, at per day of eight working hours or part thereof, £4, when specially put into steam for the company. If at any time the company should ask for the use of an engine not put into steam specially for the company, if the Minister be able to supply it, he will do so at a charge of £1 per return trip. The Minister will supply carriage-stock at such times as it may be convenient to the Eailway Department—only, when so supplied, the following charges will be made at per day or part thereof: First-class, six-wheeled carriage, 10s.; composite or second-class carriage, 7s. 6d.; first-class small carriage, 65.; composite or second-class carriage, 45.; brake-van, 3s. As the Government has only a very limited supply of rolling-stock no supplies can be guaranteed on public holidays. The company's line and trains must at all times be open to the Minister's officers to travel on and about, and to inspect and to examine. Should the company's line or appliances of any kind be in such a condition that, in the opinion of the District Eailway Manager, or any other person deputed by him, the Government engines and rolling-stock would be liable to injury on the company's line, the District Manager may decline to permit any Government engine or rolling-stock to run on the company's line until, in his opinion, the line and appliances are in a fit and proper order. The company shall make its own arrangements for booking passengers and parcels by the guard or person in charge of the company's train; but the Minister will furnish the company with any forms or tickets necessary for such booking. The company's guard shall render daily to the District Traffic Manager, Wanganui, a return of all passengers and parcel-bookings and receipts in such form as the District Manager may require; and the District Eailway Manager, or any person deputed by him, may at all times have the right of examining the returns on account of any traffic carried on the line, or checking any traffic going out, and the company's servants shall render any assistance required. Terminal charges will be made by the Minister to the company as follows : For each passenger starting from or arriving at Wanganui the company shall pay the Minister Id., and for each parcel despatched from or arriving at Wanganui the company shall pay the Minister Id. per cwt. or part of a hundredweight.

The company shall pay to the District Eailway Manager, upon the expiration of each fourweekly accounting period observed on the New Zealand railways, within three days of demand in writing from the District Eailway Manager, all charges made in accordance with the terms of this agreement, together with the terminal charges on account of passengers and parcels. If any of the company's servants at any time neglect or refuse to observe the orders of the Government officers, the District Manager may, without further process, exclude such servant from entering the Government premises. Should the company neglect or refuse to fulfil any of the conditions hereinbefore stipulated, the Minister may, without further process, cease to permit the company's trains to enter or leave the Government railway premises, and the company shall have no claim for compensation or damages on account of such stoppage, or on account of any action arising therefrom.
