SUBJECT TO AWARD
MEAL SERVICES OF CLUBS THEATRE SWEET SHOPS (By Telegraph.—Special to Times) AUCKLAND, Wednesday Mr Justice Tyndall gave reserved ! judgment in the Arbitration Court today on an application by golf clubs, l women’s and other similar clubs and the proprietors of theatre sweet shops for exemption from the provisions oi the New Zealand tearooms and restaurant employees’ award. The Court held that clubs were bound by the award where workers were employed for the preparation and serving of meals or refreshments of the nature usually obtained in tearooms and restaurants. Employees preparing and selling milk shakes in theatre sweet shops also came under the award. Mr W. Cecil Prime, employers’ representative on the Court, entered a dissenting opinion. He considered the decision did not give sufficient consideration to equity and common sense. He had no objection to workers in the classes of occupation being protected by awards, but he considered this particular award was never designed in the first place to cover such activities.
