SMOKE NUISANCE

LEGAL POSITION DEFINED FRANKTON DAIRY FACTORY Legal advice on the question of the smoke nuisance created by the New Zealand Co-operative Dairy Company Ltd’s factory at Frankton was received at a meeting of the Hamilton Borough Council last night when a letter was received from the borough solicitors, Messrs Swarbrick and Swarbrick. * The letter was in reply to an inquiry recently made by the council. “The mischief is one particularly mentioned by the Health Act,” said the borough solicitor, “and if the inspector’s report is correct and can be supported by evidence there shouW be no difficulty in getting a conviction.” However, said the letter, it was suggested that the company be written to before action was taken. If the company could be induced to refer the matter to its solicitor, the borough advisers felt sure he would advise them to take steps to abate the nuisance. On the motion of the Mayor, Mr H. D. Caro, the solicitors were instructed to take the appropriate steps.
