DRIVER FOR TRIAL

DEATH OF CYCLIST (By Telegraph.—Press Association) AUCKLAND, Thursday A charge of negligently driving a motor-car on July 5 in Great North Road, thereby causing the death of a cyclist, Edward Hunter Peters, was brought against John Wallace Garrett, aged 41, tramway motormaiv in the Police Court today. The police produced evidence of the collision and stated the cyclist was riding 6 feet 4 inches from the left-hand kerb. There was a reflector on the rear mudguard. Mr Goldstine, for Garrett, said the accident happened in a dark locality and there was not a shred of evidence of negligent driving. The Bench held that a case had been made out and accused, who pleaded not guilty, was committed for trial. Bail was fixed at £IOO.
