ACCIDENT TO MINER

COMPENSATION CLAIMED (Special to Times) AUCKLAND, Thursday Compensation for an injury alleged to have been received on January 23, 1939, was sought by a miner, John Tudor, of Huntly (Mr C. J. O’Regan, of Wellington), in the Arbitration Court today from Glen Afton Collieries, Limited (Mr Hore). Mr Justice O’Regan presided. Plaintiff, in his statement of claim, alleged that the accident arose out of and in the course of his employment. He slipped and struck himself violently against some projection, and as a result he had since been totally disabled. Plaintiff claimed compensation at the rate of £3 0s 7d a week to the date of the hearing of the case, costs, and such further relief as might be just. The defence was a denial that the accident had happened as alleged. If it did so happen, the plaintiff had failed to give notice of it as soon as practicable, and the defendant had been prejudiced in its defence. The hearing was adjourned until today. _
