SHORTER PRISON TERM
INTOXICATED MOTORIST (By Telegraph.—Press Association) GISBORNE, Tuesday A rehearing having been granted Wallace Haig Spencer, who was sentenced to one month’s imprisonment on a charge of being intoxicated while in charge of a car, he appeared before Mr J. H. Luxford, S.M., again today. Counsel for accused, Mr L. T. Burnard, said accused and his brother were endeavouring to build up a photographic business, and accused supported his mother. Two witnesses, Arthur Webb, a contractor and builder, and Cyril Batson. president of the Cosmopolitan, Club, of which accused was a member. both testified as to the good character of accused. The magistrate said that unfortunately, through an oversight, the present facts had not been before him at accused's trial. In view of the fact that it was now 14 days since he had passed sentence, accused would be imprisoned until the. rising of the Court. Regarding the cancellation of accused's licence, and the prohibition from obtaining another for one year, t.he magistrate said he would allow that penalty to stand.
