MISCONDUCT ALLEGED
DESERTION BY HUSBAND CASES IN SUPREME COURT In the Supreme Court, Hamilton, today, before Mr Justice Smith, Frederick Rikihana Larkin Mr J. F. Strang; sought a divorce from Rona Matilda Larkin on the grounds of adultery. Petitioner, a sawmill henchman of Owhango, said he married respondent at Auckland on June 16. 1921, and there were six children. Respondent wanted custody of the youngest child, who was at present under the care of the Child Welfare Department. About a week before Easter, 1938, petitioner * wife left him, saying she was going to act as cook to the men at the mill. However, witness knew that she was Irving with a man named A. J. Peard in a house next to that which petitioner occupied. The co-respondent later left for Putaruru and respondent went to her mother s place ai Mercer. A decree nisi, to be made absolute after three months, and the interim custody of the children, were granted petitioner. An order for the restitution of conjugal rights was made by His Honour when Alys Thora Jessica McDonald, of Hamilton (Mr A. L. Tompkins proceeded against Lionel Edward Augustus McDonald. Petitioner said she married respondent in August, 1930, and there were two children. Fur the Just four years or more she and her husband had not been very happy together, as he expressed a wish to lead his own life. He left her in December. 1938, saying be considered it would he better it !»«• led his own life entirely. Petitioner's efforts to get her husband to return were in vain, but she genuinely wanted him back.
