SHEEP RUN OVER
TRANSPORT DRIVER’S ACT BUTCHER? AWARDED DAMAGES When a driver of the Felton Waikato Transport Company, Limited, Thomas Charles Henry Scott, ran into a flock of sheep at Te Ha pa on December 22 last, one beast was almost cut In half and several others were either killed outright or injured. As a result damages amounting to £2 10s rtd were awarded to W. R. Shattock. Limited, butchers, of Hamilton, wlm owned two of the injured sheep, by Mr S. L. Paterson. S.M-, in the Magistrate's Court, yesterday. The defendant company, the Felton Waikato Transport Company, Limited, was ordered to pay costs amounting to £3 Cs. Mr W. P. Gray, counsel for plaintiff, said on the morning of December 22 a flock of about iuo sheep were driven by a drover out of an accomm dation ; fcddock ai Te Rapa. Some 5 i were already on the road when defendant's lorry approached and the driver, failing to stop, ran into the sheep, which were piled up under the vehicle. Three were killed and eight were injured. Of these eight, three died on the journey to Horotiu, where they were being taken by the defendant's lorry. Three more injured sheep were condemned at the works, making a total of 13 beasts lost. Plaintiff owned two of these. Defendant submitted that the weather was fogey and visibility was bad. "It is a simple case. The driver should have seen the sheep and his story of poor visibility is absurd,” commented the magistrate.
