ACTION FOR DAMAGES
SETTLEMENT EFFECTED SEQUEL TO ACCIDENT . Arising out of an accident near Waharoa on July 29, 1937, the action in which Wilson Hayward Blade (19), a farm labourer of Tauwhare, claimed £142 special damages and £3OO general damages from John Thomas Andrews, carrier, of Turanga-o-mo-ann. has been settled by compromise. The statement of claim stated that on July 29 plaintiff was riding his motor-cycle from Matamata to Ngarua and was struck by Andrews’ lorry near Waharoa. Blade suffered a compound fracture of the right leg and minor bruises. Appearing in the Supreme Court yesterday before the Chief Justice, Sir Michael Myers, Mr W. J. King, on behalf of plaintiff, read the motion approving the compromise and stated that the amount agreed upon was £284 11s 2d. The amount was to be paid to the Public Trustee and disposed of in payments to plaintiff in respect of his wages, hospital and medical expenses incurred as a result of the accident, and the cost of the legal proceedings. The balance was to be held by the Public Trustee for the maintenance, education or benefit of the plaintiff.
