OWNER SECURES ORDER MAGISTRATE’S COURT CASE “I think the balance' of hardship lies with the defendant, but after all a man's house is his own house and there must be strong circumstances it' an order of possession is not to be made. I will, however, give the defendant three months in which to secure fresh accommodation,” said Mr J. G. L. Hewitt, S.M., in the Magistrate's Court, Hamilton to-day in making. an order for possession in favour of a landlord against a tenant. The plaintiff in the case, James Alexander Sykes, a motor mechanic, said the ill-health of his wife had prevented him entering into possession of his house when he first bought it. Tho present tenant, defendant, was paying him 18s 6d a week, whereas he himself was paying 25s a week in rent. He had been trying l'or about three and a-half months to secure possession without success. He was living at Hamilton East and an offer of exchange of houses had been made to defendant and refused by him. The defendant, Cyril Be'eehen, said he was a railway shunter stationed at Frankton, where plaintiff's house was situated. His hours were irregular and necessitated his living close to his work. He had trjed unsuccessfully to get other suitable accommodation, at a rental he could afford but bad not succeeded.
