APPEAL DISMISSED.

MOTOR COLLISION CABE. (By ToleKrnnh—Press Association.) WELLINGTON, Monday. The Appeal Court to-day dismissed the appeal in the case of Peter Percy Hurlstone and Harold Oscar Steadman heard on June 23. Appellant Hurlstone had brought an aotion in the Supreme Court to set aside a judgment in a motor collision oase in favour of respondent.. This was refused by Mr. Justice Callan whose Judgment was confirmed by the Chief Justice, Sir Michael Myers, and Mr. Justice Kennedy and Mr. Justice Northcroft. Mr. Justice Ostler was of the opinion that the case should be remitted to the Supreme 'Court to determine whether as a question of faot judgment in favour of respondent had been procured through his fraud.
