CHARGE OF ASSAULT.
FARM HAND CONVICTED. SHOOTING OP DOG. Charged with striking Jack Leslie' Spencer on February 10 and with ill-j treating a dog by shooting it and caus- | ing it unnecessary suffering, Alfred Raymond, a farm-hand, of Tauwhare, ■ was fined £1 with costs on the first charge and the second charge was dismissed in the Hamilton Magistrate’s j Court, yesterday, by Mr S. L. Paterson, S.M. Accused did not appear and the prosecution was conducted by Sergeant T. Kelly. Jack Leslie Spencer, a lorry driver, [ stated that on the morning of Feb-1 ruary 10, ho had pulled his lorry up by a gate near the Matangi factory •when accused, whom he did not know, came up, tore the side curtains down and said: “Come on'out of that. I want, a piece of you about that dog.” Witness understood that defendant was working for a man whom witness was taking proceedings against for the shooting of a dog. Witness did not get down but later when he got out to crank his truck defendant struck him several times and a fight ensued. Sergeant Kelly stated that the second charge was for the shooting of a dog owned by Norman Mills Ferris, which had been badly injured. He produced a statement, by defendant, who said that he and another employee had shot at several dogs on their employer’s instructions, for worrying; sheep. In one part of the statement he said he had shot Ferris’ dog and in two other parts he said he had not. I*n dismissing the charge His Worship said that it was not definitely proved who shot the dog.
