RESERVED JUDGMINT GIVEN. DEFENDANT'S STORY BELIEVED. Reserved judgment in the action E. L. Thwaites v. H. R. Templer was given by Mr S. L. Paterson, 5.51.. in tho Hamilton Magistrate's Court to-day. The action was the sequel to an accident on the Main South Road near Taupiri on the night or May 6. 1935. between a car owned and driven by E. 'L. Thwaltes, solicitor. at Auckland. and a car owned by H. R. 'l‘empier. farmer, of Hamilton, and driven by his sister, Miss Jean Templar. Thwaites. who was represented by Mr E. F. Clayton-Greene. claimed £43 125 6d from defendant. who was represented iby Mr \\'. J. King. and counterclaimed for £46 155. “ The evidence of the parties \val contradictory and l have had to be‘iieve one or the other," commented ‘Hls \Vorship. ~- After a careful study or the evidence 1 am or the opinion that Miss Templer‘s story and that oi her witnesses is the correct version of the accident." In giving his reasons for his decision Mr Paterson pointed out many irregularities in the evidence or piaintii! and his witnesses. Judgment was given for defendant. and the full amount of the counterclaim, H 6 155, wiih costs, was also allowed.
