EXCESSIVE DAMAGE.
JURY'S AWARD QUASHED. JUDGE ORDERS RE-TRIAL. (By Telegraph.—Press Association.) PALMERSTON N\, Thursday. Granting a motion brought by defendant’s counsel, Mr Justice Ostler in the Supreme Court made an order vacating a judgment and ordering a retrial at the next session of the case In which the jury last week awarded Mrs Edith Matilda Hodgson, of Wliakaronga, £2500 general and £lO9 6s special damages, the full amount claimed, against the Hawke’s Bay Farmers’ Meat Company for serious injuries suffered when she was knocked down by a car in December last. His Honour said the case was not one where vindictive damages should be given. The purpose of damages was compensation for injury and this h;pi been pointed out to the jury who Ignored it. lie considered the amount of general damages was so large that no Jury could reasonably award it. special damages were not disputed.
