POINT OF LAW RAISED. CASE FOR MAGISTRATE. (Special Reporter.) TE AROHA, Wednesday. .\n interesting point or law was raised by counsel for the defence in the Te Aroha Magistrate's Court to-day when Robert Allen Pole, who had been charged earlier in the day with negli—gently driving a. motor-lorry so as to cause the death or Thomas Doyle on April 16, was charged with having in—euiaient brakes on his motor-lorry. Mr A. H. Powell who appeared for accused stated that. there was no case against Pole as the summons read that accused had not two independent lll'llkcs tilted to his vehicle- The question of the olllciency or the brakes was neither mentioned not implied in the uhnrge. After brief deliberation the Justices. .\lcssrs 0. Hodge and J. A. Hepburn reserved the case for hearing at the next sitting or the Magistrate‘s Court. On a further charge of having inofllclent lights tlttcd to the lorry Polo was convicted and ilncd £2 and costs.
