The case for the Crown was concluded and the defence was opened, accused himself entering the box, Counsel for accused said that Gunn would say he was ignorant as to how the injury was caused, and that he did ’not’ consciously strike Beattic. He would say he picked up a stick to urge his horse through a gateway. It would be stated that the horse reared and that deceased was thrown against a. straining-post. Accused was never on the same side or the horse as (le—ceased, \vhoser- injuries might have been caused in a variety of ways.

Evidence along these lines was given by accused, who will be cross-exam-ined tu—morl‘ow morning.
