The summons for this case I had been issued on May 2nd, but defendant ! not being found, the summons had beep re- | . issued on July 22nd. In the meantime the \ defendant had paid the rates, and the Road , 1 Board, as represented by Capt. McPherson, t ! collector, etc., claimed costs. Mr O'Neill, t , on behalf of his client, claimed expenses, contending that as the rates had been paid t before the re-is Hie of the summons, there t i was no need for summonsing. The R.M. e reserved judgment until next court day. j A. Niccol v. Burd Bros.—Claim £44 f 11s for work done. The plaintiff has been building bridges for defendants, who are t contractors in the Taupo district. The s work done amounted to 17,050 feet at Gs ( Der 100 superficial feet, amounting to £51 c 3s, and the defendants claimed £6 12* for t board, which brings the claim to £44 11s. The defendants gave a cheque for this r amount, asking that the cheque be hold c over for three months. This was done, and J the cheque when presented was returned, v marked N.S.F. The defendants in the ( meantime filed. The Government have t some money in hand belonging tn the de- t fondants on this work, and the plaintiff is p suing under the " Workman's Wages Act, f 1884." Messrs Hay and Swarbrick ap- £ peered for the plaintiff, and the defendants' t evidence will be taken in T-iuranga. u
